By downloading, installing, or using the Prime Progression app or visiting this website, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app or website. Prime Progression is operated by Software Technologies Oskar Brunner, Waterloostr. 57, 86165 Augsburg, Germany.

2. Description of Service

Prime Progression is a fitness tracking application that provides workout logging, nutrition tracking, recovery monitoring, and AI-powered coaching. The app is designed as a personal fitness tool to help you track and plan your training progress.

3. Not Medical Advice

The content provided by Prime Progression — including workout plans, nutrition data, recovery scores, and AI Coach responses — is for informational and fitness tracking purposes only. It does not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any new exercise program, making significant dietary changes, or if you have any health concerns. Never disregard professional medical advice because of information provided by this app.

Use of the app is at your own risk. Software Technologies Oskar Brunner accepts no liability for injuries, health issues, or other consequences arising from use of the app's content or features.

4. User Responsibilities

You agree to:

— Use the app only for lawful, personal, non-commercial purposes
— Provide accurate information when creating your profile
— Keep your account credentials confidential
— Not attempt to reverse-engineer, decompile, or modify the app
— Not use the app in any way that could harm other users, the service, or third parties
— Not upload or share content that is illegal, harmful, or infringes third-party rights

5. Intellectual Property

All content, features, and functionality of the Prime Progression app and website — including but not limited to the name, logo, design, text, graphics, software, and source code — are owned by Software Technologies Oskar Brunner and are protected by applicable intellectual property laws.

You retain ownership of the personal data you enter (workouts, nutrition logs, measurements). We do not claim ownership over your personal fitness data.

6. Premium Subscriptions

Prime Progression offers optional premium features via in-app subscription. Subscriptions are managed and billed through Apple's App Store. By subscribing, you agree to the App Store Terms of Service. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. To cancel, go to your device's App Store subscription settings. Refunds are handled by Apple in accordance with their refund policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Software Technologies Oskar Brunner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the app or website. Our total liability for any claim arising from use of the service shall not exceed the amount you paid for the service in the twelve months preceding the claim.

The app is provided "as is" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose or non-infringement.

8. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective when posted to this page. Continued use of the app after changes are posted constitutes your acceptance of the revised terms. We will notify users of significant changes through the app.

9. Governing Law

These Terms of Use are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Augsburg, Germany, to the extent permitted by law.
