1. Acceptance of Terms

By downloading, installing, or using Prime Progression ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

3. Description of Service

Prime Progression is a fitness and nutrition tracking application that provides:

• Workout logging and progress tracking
• Nutrition and meal tracking
• AI-powered coaching recommendations
• Health data integration (with your permission)
• Recovery and readiness scoring

4. Account Registration

To use certain features, you must create an account. You are responsible for:

• Providing accurate and complete information
• Keeping your login credentials secure
• All activity that occurs under your account

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscriptions and Payments

The App offers free and premium features. Premium subscriptions are processed through the Apple App Store or Google Play Store.

• Subscription prices are displayed before purchase
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
• Cancellation and refund policies are governed by the respective app store
• You can manage or cancel your subscription in your device's app store settings

6. Health and Medical Disclaimer

The App is not a medical device and does not provide medical advice. All information, including AI coaching, recovery scores, and training recommendations, is for informational and educational purposes only.

• The App is not a substitute for professional medical advice, diagnosis, or treatment
• Always consult a qualified healthcare professional before starting any exercise or nutrition program
• If you experience pain, discomfort, or health concerns during exercise, stop immediately and seek medical attention
• Recovery scores and training readiness indicators are estimates based on limited data and should not be relied upon as medical assessments

7. AI Coach Disclaimer

The AI Coach feature uses artificial intelligence (Google Gemini) to provide fitness and nutrition suggestions. You acknowledge that:

• AI-generated advice may be inaccurate, incomplete, or unsuitable for your specific situation
• The AI Coach is not a certified personal trainer, nutritionist, or medical professional
• You are solely responsible for evaluating and acting on any AI-generated recommendations
• AI responses may vary and are not guaranteed to be consistent

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's services or servers
• Create multiple accounts to abuse free features or trials
• Use the AI Coach to generate harmful, abusive, or inappropriate content
• Misrepresent data or impersonate another person

9. Intellectual Property

The App, including its design, code, content, and branding, is the intellectual property of Software Technologies Oskar Brunner. You may not copy, modify, distribute, or create derivative works without our written permission.

Your data (workouts, nutrition logs, etc.) remains yours. By using the App, you grant us a limited license to process your data solely to provide the service.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" without warranties of any kind, whether express or implied
• We do not guarantee uninterrupted, error-free, or secure operation of the App
• We are not liable for any injuries, health issues, or damages resulting from following the App's recommendations or AI coaching advice
• We are not liable for data loss due to device failure, app deletion, or service interruptions
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless Software Technologies Oskar Brunner from any claims, damages, or expenses arising from your use of the App or violation of these terms.

12. Changes to the Terms

We may update these Terms of Use from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the updated terms.

13. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. If you are a consumer in the EU, you also benefit from mandatory consumer protection provisions of your country of residence. The courts of Germany shall have jurisdiction, without prejudice to your right to bring proceedings in your country of residence.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
